Chima Ikwunado: Court strikes out suits against Rivers CP, others



A Federal High Court sitting in Port Harcourt has struck out the fundamental right suits against the Inspector General of Police, Commissioner of Police, E-crack Commander SP Benson Adetuyi, filed by the wife and father of late Chima Ikwunado.The court struck out the suit after Counsel representing the applicants, Adaugo and Kelvin Ikwunado Princess Lawrence applied to withdraw the suits due to errors in her applications.

Counsel to the Respondents also filed an application seeking the court to dismiss the suits as it is an abuse of court process.

The Presiding Judge, Justice James Omotosho, after listening to Counsels in the matter, struck out the suits with the reason that the application does not seek Justice for the life of the deceased that was cut short, but for people still living.

Justice Omotosho stressed that the application has bridged the right to life of the deceased.

The Judge, however, refused to grant the application filed by the Police Counsel seeking to dismiss the case, on grounds that the Police Counsel filed their counter affidavit out of time.

Recall that the court at the last sitting directed the Applicants Counsel to regularise her court processes due to errors in her applications.

Speaking on the court decision, Sokari Egop, Counsel to the Respondents: Inspector General of Police, Commissioner of Police, E-crack Commander SP Benson Adetuyi, told our correspondent, Tina Amanda, that the Applicants’ Counsel withdrew the matter due to her deficiency in what she filed, adding that the court did justice too by not granting their application for dismissal of the suits.
