Appeal Court Nullifies Hon. Oko Jumbo’s Position as Speaker RSHA

The Abuja division of the Court of Appeal overturned the exparte order issued by the Rivers State High Court that barred Martin Amaewhule from acting as Speaker of the Rivers State House of Assembly.

The appeal court also lifted the restriction placed on 24 other assembly members from accessing the legislative complex or performing their duties. Justice Jimi Olukayode-Bada, leading a three-man panel, ruled in favor of Amaewhule and the other members, stating that only the Federal High Court has jurisdiction to hear such matters according to section 273 of the Constitution.

Implications of Today's judgment of the Court of Appeal

  1. Any actions taken by Hon. Oko Jumbo, such as screening and confirming illegal Commissioner nominees and Caretaker committees, are invalid.
  2. Any funds spent by Gov. Fubara without proper approval from the budgeting and Appropriations by Rt. Hon. Martins' House of Assembly are unlawful.
  3. All laws passed by Rt. Hon. Martin's Assembly, including the extension of the Tenure of Elected Chairmen, Vice Chairmen, and Councillors, are now in effect
